METALHEAD TOURS®, METALHEAD TOURS® LATAM, METALHEAD TOURS® GROUP:

METALHEAD TOURS WELCOMES YOU AND THANKS YOU FOR YOUR PREFERENCE, INFORMING AND INVITING YOU TO BE AWARE THAT

• The terms "METALHEAD TOURS," "METALHEAD TOURS LATAM," "we," and "our" refer to Metalhead Tours, with its address in Bogotá D.C. The term "You" refers to the user of the services offered by METALHEAD TOURS through any of its currently valid channels - telephone and/or website and/or social networks (the "Platform/s" and/or the "Site") - or that may be used in the future.

• METALHEAD TOURS is not the provider of the Tourist Services and acts on behalf of the Providers, so it is not directly or indirectly obligated to the execution of the Tourist Service. When You contract Tourist Services through METALHEAD TOURS, you are entering into a contract directly with the Provider who offers their Tourist Services through our Platform. METALHEAD TOURS acts as an intermediary between You and the Providers of Tourist Services and acts on behalf and representation of the Provider.
• By contracting Tourist Services through METALHEAD TOURS, You agree to have read, understood, and agreed to the terms and conditions set forth below. Likewise, You warrant that:
* You are of legal age;
* You have full capacity to enter into agreements;
* You only use the METALHEAD TOURS Platform to book or contract Tourist Services for Yourself and/or for another person for whom You are authorized to act;
* All information You provide to METALHEAD TOURS is true, accurate, current, and complete.

• These conditions are of a general nature and apply to the intermediation services provided by METALHEAD TOURS and in no way replace or modify the legal limitations or the special or specific conditions that each Tourist Service Provider has defined for its Tourist Services. METALHEAD TOURS is not responsible for, nor does it have any influence on, the specific conditions established by each Provider for the provision of their Tourist Services.

• METALHEAD TOURS states that its intermediation activity in the commercialization of Tourist Services does not guarantee that the chosen destination does not present risks to the health and integrity of individuals. METALHEAD TOURS is not responsible, directly or indirectly, for damages or losses that You or those traveling with You may suffer before, during, or as a result of the chosen destination. METALHEAD TOURS is not responsible for events arising from fortuitous events or force majeure, including climatic phenomena, acts of nature, labor conflicts, among others, that could occur before or during the provision of the Tourist Service, and that could eventually delay, interrupt, or prevent its execution.

• Before confirming your purchase request by clicking the Buy button and prior acceptance of these General Conditions (the "Purchase Request"), we advise You to review the specific terms and conditions applicable to the Tourist Service You wish to contract. This will avoid surprises and allow You to enjoy your trip as planned. The policies of each Tourist Service are established by each Provider without METALHEAD TOURS' interference. It is particularly clarified that METALHEAD TOURS has no influence on the collection of penalties by Providers or fare differences if applicable, which will depend on each Provider's policies. The amounts to be paid for the platform already include the corresponding commission for external services. Prices, descriptions, and details of services are subject to change without notice.

• The mere use of the Platform implies acceptance of each and every one of the general and specific conditions included in these terms and conditions. Reading them will allow You to better exercise your rights as a consumer. We suggest printing and keeping them, along with the rest of the travel documentation.


IF YOU CONTRACT TOURIST SERVICES THROUGH METALHEAD TOURS, PLEASE NOTE THE FOLLOWING INFORMATION:


1. HOW DOES THE RESERVATION AND PURCHASE PROCESS WORK?

When You submit a Purchase Request through the METALHEAD TOURS Platform, You authorize us to manage your reservation and process the respective charge(s) to your account or card through different payment platforms. Pay close attention to our subsequent communications, where we will inform You about the progress and status of your Purchase Request. The successful completion of the reservation process and/or confirmation of the purchase depends on the full and timely payment of the price and/or fee for all Tourist Services. Until the total payment of the reservation is confirmed, the Purchase Request will be on hold and could be canceled by the Provider. The definitive confirmation and total payment of the Tourist Services and prices will occur with the issuance of the electronic ticket(s) or the sending of the voucher - as applicable - and your purchase receipt.

2. WHAT PERSONAL DATA NEEDS TO BE ENTERED?

You must complete all fields with accurate data to make valid reservations for Tourist Services through METALHEAD TOURS. By entering your personal data on the Platform, You declare that such data (the "Personal Data") is accurate, precise, and true, and You undertake to update such Personal Data as necessary. METALHEAD TOURS is not responsible for the accuracy of the Personal Data provided by You. You guarantee and are responsible for the truthfulness, accuracy, validity, and authenticity of the entered Personal Data. Remember that all your data must match exactly with the Travel Documentation as defined in point VI.

3. WHAT CONTACT INFORMATION IS NEEDED?

You must enter an email address in the "Contact Information" section. That email is our means of contact with You. Check that the email address provided as a contact point is correct and stay tuned to the information that will be sent to that email. It will be considered that You were duly informed of the confirmation of your Purchase Request or any inconvenience or variation to it with the sending of such information to the email address provided by You. Please note that if the email entered by You contains any error, You will not receive fundamental communications for the management of your Purchase Request.

4. WHAT DOCUMENTATION WILL I NEED FOR TRAVEL?

You have the duty to responsibly inform yourself about the legal and/or migratory and/or health requirements that You or the people traveling with You may need to travel as planned (the "Travel Documentation"). Check in advance the entry conditions for the destination country and/or transit, special visa and/or passport conditions, driving licenses, vaccines, permission for minors, or other document requirements, both for the destination countries and transit countries, even if it is not necessary to leave the airport. If required and not available, make the necessary arrangements to obtain it in advance. Requirements may vary depending on the destination country and/or transit and according to your nationality and/or residence and/or the documentation with which You travel. Remember that it is your responsibility to comply with all entry and/or transit requirements and/or documentation required by immigration, customs, and/or health authorities of the destination country/s and/or transit. We advise You to check all necessary requirements with the respective Embassy or Consulate before booking and departing. For more information visit: https://www.iatatravelcentre.com/. Check the expiration date of the documentation in advance and note that, in some countries, the expiration date must not be earlier than six months from the arrival in foreign territory. In the case of traveling with minors under 18, in addition to the enabled travel document (National Identification Document or Passport), they will need authorization according to different considerations:
* If the minor travels with both parents, it will be sufficient for them to prove the relationship through the Civil Registry of Birth, Birth Certificate, or Certificate of Birth (regardless of the date of issue) or the minor's Identification Document, where the filiation data of the parents are stated,
* If he/she travels with only one of his/her parents, in addition to demonstrating the parental relationship with any of the mentioned documents, he/she must accompany the authorization of the absent father/mother, and
* If he/she is the child of minors, he/she will need the authorization of the parents and the permission of one of his/her grandparents. Regardless, review the Travel Documentation required according to the type of transport, the Provider, and the origin and/or destination of the transport, as requirements may vary depending on whether You travel by sea, land, or air and according to each Provider. In the case that the minor/s do/does not travel accompanied by a responsible adult, please review the unaccompanied minor policies of each Provider. 5. WILL I HAVE THE RIGHT OF WITHDRAWAL?

METALHEAD TOURS informs You that, in accordance with the provisions of Article 47 of Law 1480 of 2011, (Colombian Consumer Statute), the right of withdrawal operates in all contracts for the sale of goods and provision of services through financing systems, sale of timeshares, or sales that use non-traditional or distance methods, which by their nature should not be consumed or have not begun to be executed before five (5) days. To exercise this right and receive the amount paid, without discounts or retentions, You must, within the five (5) days following the purchase transaction, notify METALHEAD TOURS of your decision to do so, through electronic means or similar. METALHEAD TOURS will handle the presentation and follow-up of your request to the tourist service provider, and - if it has been paid - it will be the tourist service provider who must directly proceed with the refund of your money, through a credit, a chargeback to your credit card, or the return of the amount paid, according to the most convenient method of refund. If the payment had been made by bank transfer, METALHEAD TOURS will require your data again to process the refund by this means.

6. ONCE A PURCHASE REQUEST IS CONFIRMED, CAN I CANCEL IT? IF I DO, ARE THERE ASSOCIATED COSTS?:

If you request a cancellation outside the deadlines and procedures explained in the previous point, METALHEAD TOURS will carry out the presentation and follow-up of your request, but the final decision will be made by the Tourist Service Provider. The procedure and special conditions governing changes or cancellations in a reservation confirmed by you are determined by the Tourist Service Providers, who may establish fines or total penalties applicable to the requested changes. Remember that there are Tourist Services that, at the discretion of the Providers, do not allow changes and/or refunds, or allow them with restrictions and/or penalties, even in cases of illness, strikes, weather phenomena, etc. Remember that each Provider defines their penalties without METALHEAD TOURS intervention or interference. * It should be clarified that Providers are not obligated to exempt the passenger from the contract conditions, even in documented cases of illness or physical incapacity preventing them from traveling; that is, if the paid fare includes a penalty for modifications/refunds or does not allow changes and/or reimbursement, the Provider can charge these fees or deny the refund of the reservation cost.
* If it is not possible to exempt any service offered by the providers from penalties or changes, METALHEAD TOURS will inform you that it is non-refundable. In case of cancellation of confirmed reservations for any reason, it will not be refunded as it corresponds to a service effectively provided by METALHEAD TOURS. Likewise, in the event that you request the change or cancellation of a Tourist Service, METALHEAD TOURS may charge an additional Management Fee.
* METALHEAD TOURS will not generate refunds. It could be considered in certain cases as credit for future purchase, with a maximum time of 1 (one) natural year, which you will send in writing by email along with the required support. If necessary, you may transfer the contracted services to another passenger, and you must take care of this procedure without fail.
* When you request a change, you are canceling a confirmed reservation and requesting a new one that will be governed by the particular conditions applicable at the time you make the change, so, in addition to the applicable penalties, there may be a fare difference consisting of the value resulting from the difference between the originally paid fare and the new fare according to fare availability at the time of making the change (the "Fare Difference"). Remember that tourist rates are dynamic and depend on variables such as advance purchase, travel dates, and promotions.

7. WHAT HAPPENS IF I DO NOT SHOW UP TO USE A RESERVATION?

If you do not show up to use your reservation on the indicated date and times (or arrive late), it is considered what is known in the tourism market as a No Show, and you will not be entitled to demand a total or partial refund of the amount paid. If you are not going to use your reservation in whole or in part, or if you are going to arrive late to use your reservation, we recommend notifying METALHEAD TOURS in advance to know the applicable restrictions.

8. Responsibilities:

Metalhead Tours explicitly declares that it acts solely as an intermediary between travelers and entities or individuals called to provide the services indicated in the itineraries. Therefore, it declines all responsibility for deficiencies in any of the services provided, as well as any accidents, damage, injury, delay, or irregularities that may occur during the execution of the services to the people who carry out the trip through its mediation. As well as luggage and other objects of their property.
Metalhead Tours periodically updates the information about its products displayed on the metalheadtours.com site; however, neither the latter nor Metalhead Tours are responsible for the damages that could result from errors and omissions in the information contained on the site.
Metalhead Tours declines all responsibility for delays, advances, or cancellations that occur by airlines or transport companies, with the expenses that arise being the responsibility of the passengers.
If excursions do not reach the minimum number of expected travelers or for any justified reason Metalhead Tours is forced to suspend any of the trips, registered passengers will have no right other than the refund corresponding to the amount paid, with express waiver of any other claim.
Metalhead Tours is not responsible for the criteria and control in the granting of categories to hotels. Those that appear in the promotion of packages and in the itineraries sent to passengers are officially granted by the tourist authorities of the country.
Metalhead Tours is not responsible for the luggage and other personal effects of the client, who travels at their own risk. Therefore, it is recommended that the passenger take out travel insurance to cover the mentioned risk.
Metalhead Tours is not responsible for the purchase of airline tickets, procedures such as passport and visa, and other personal effects of the client such as personal expenses or expenses not specified in our programs.
Metalhead Tours is not responsible for adverse natural atmospheric conditions, demonstrations, riots, wars or rumors of war, or for any fortuitous or force majeure case not attributable to the will of either party, which affects the trip contracted by the passengers. The use of air or land transport by passengers implies a direct relationship between the transport companies and the passengers. Metalhead Tours recommends the hiring of insurance against flight cancellations, which are not marketed by it.
When transport is carried out in buses owned or rented by the organizer, the traveler expressly submits to the legislation on road accidents in the nation where the vehicle is registered, expressly waiving any other right that could correspond to them, by virtue of which indemnities would be paid to the interested parties, beneficiaries, or legal representatives in the country of registration of the vehicle and in the legal currency of the country. The payment of possible indemnities in the event of an accident corresponds solely to the insurance companies, excluding any liability from third parties such as airlines, maritime companies, operators, etc.

9. Customer Acceptance:

The customer declares to know and accept these general contracting conditions, and this acceptance is ratified by any of the following acts:

1. The partial or total payment of the contracted services before the start of the trip, by any form or modality.
2. The acceptance of administrative expenses by national or international bank transfer, likewise by any payment method on web platforms.
3. By using any portion of the contracted services.

CURRENT PROMOTIONS

* Remember that promotional rates are non-refundable.
* In the case of "from" rates, the final price is limited according to the quotation of the international currency (Dollar or Euro) in effect on the day of the last payment. It is subject to changes and availability at the time of booking the tourist package.
